2.1 Merch of Companies with an Agreement

• We partner with certain European companies (“Partner Companies”) that have contracted with us for the production and listing of their merchandise.

• For these Partner Companies, the merchandise (the “Products”) can be ordered directly on our Website.

• Production costs are covered by the Partner Company. We cover the storage, fulfillment, and shipping costs for orders placed through our Website.

2.2 Merch of Companies without an Agreement

• We also showcase merch or potential merch concepts from companies we do not currently have an agreement with (“Non-Partner Companies”).

• The Products under these Non-Partner Companies are not available for direct purchase.

• Visitors may submit requests or upvote to indicate interest in these companies’ merchandise. We may then contact the Non-Partner Company to explore a future partnership.

2.3 Requesting New Companies

• Website visitors can request the addition of new companies by providing suggestions or feedback through the designated form or feature on the Website.

• We reserve the right to accept or reject any suggestion and are under no obligation to pursue an agreement with any suggested company.

3. Eligibility

By using this Website, you represent that you are at least the age of majority in your jurisdiction, and you agree to abide by these Terms and all applicable local, national, and international laws and regulations.

4. Account Registration

• You may be required to create an account to purchase merchandise.

• You are responsible for maintaining the confidentiality of your account login credentials.

• If an order is canceled after payment has been charged, we will issue a refund in the original form of payment.

• We handle storage, fulfilment, and shipping for orders of merchandise from Partner Companies.

• Shipping times and costs (if any) may vary depending on your location and the availability of the Product.

• Any estimated delivery dates are approximate; we are not liable for delays caused by events outside our control.

7. Returns and Refunds

• Return and refund policies for specific merchandise may vary and will be clearly stated on the product page or during checkout.

• Our default policy is a 14-day return period for unused and unopened items, subject to proof of purchase.

• To initiate a return, please contact our customer service at european-merch@mondaymerch.com.

• Refunds will be processed once we receive the returned item in acceptable condition.

8. Intellectual Property

8.1 Ownership of Content

• Except for third-party logos, trademarks, and other intellectual property (“Third-Party IP”), all text, graphics, logos, images, and software on the Website are owned by or licensed to Monday Merch.

• All Third-Party IP (including trademarks, logos, and brand names) displayed on the Website belongs to their respective owners.

8.2 Use of Third-Party Logos and Trademarks

• We may display third-party logos, product images, or company names (collectively, “Third-Party Content”) to showcase potential merchandise, indicate user interest, or illustrate products associated with Partner or Non-Partner Companies.

• In cases where we do not have a formal agreement or partnership, such Third-Party Content is used on a fair use, informational, or nominative basis to identify the respective companies and/or their merchandise.

• The inclusion of any Third-Party Content on the Website does not imply endorsement, affiliation, or sponsorship unless expressly stated.

8.3 Claims and Removal

Any agreement is governed by, and shall be construed in accordance with the laws of the Netherlands, which shall be deemed to be the proper law hereof.
